Exclusive Exchange members are wholly responsible for ensuring the accuracy of a potential exchange or rental by corresponding with members, asking for photos, and asking for references.
Members are expected to leave the exchange property in the condition in which they found it, or better.
Members are responsible for any damage that any member of their party may cause
to another member's property.
Acceptance of these Terms and Conditions as herein set forth, is considered to be an acceptance of and consent to:
(i) pay all legal fees and court costs incurred by Exclusive Exchanges, a division of Sojourning Concepts, LLC in the event that an action of law or in equity is initiated by Exclusive Exchanges against said member and Exclusive Exchanges and Sojourning Concepts, LLC should prevail;and,
(ii) That the member agrees to pay all legal fees and court costs incurred by Exclusive Exchanges, a division of Sojourning Concepts, LLC, in the event that an action of law or equity is initiated by the member against Exclusive Exchanges, a division of Sojourning Concepts, LLC, should Exclusive Exchanges prevail in said action.
Acceptance of these Terms and conditions as herein set forth, is considered to be
an acceptance of and consent to submit any and all disputes to the jurisdiction
of the courts of Fairfax County, Virginia, United States of America, and that said
agreement shall be governed exclusively by the laws of the Commonwealth of Virginia,
United States of America.
